Overview

The primary purpose of this role is to make recoveries on litigated (or potentially litigious) claims identified to have subrogation. Use your legal knowledge for prompt and independent review of insurance claims through effective research, investigation, evaluation, negotiation and interaction with internal and external counsel, insureds, and claimants. Leverage your legal background in formulating proper resolution strategy to ensure best total outcome. The Subrogation Litigation Adjuster is part of a team focused on a Line of Business (LOB)* or function - either Workers' Comp, Property, or Auto Liability. You will maintain a solid understanding of AmTrust's mission, vision, and values. Upholds the standards of the AmTrust and Claims organization.

Responsibilities

  • Ensures appropriate investigation of the claim, including review and evaluation of underlying facts and circumstances to determine viable 3 rd parties that may be liable for the loss.
  • Working with internal and external Litigation staff, partners to ensure selection and utilization of legal counsel and that proper negotiation strategy is employed. Applies company principles and standards including planning, organizing, and monitoring legal panel services and cost in partnership with internal legal counsel.
  • May manage company CAT losses to include claims handling, negotiations, and dissemination of information to involved parties as required.
  • Review, prepare and monitor insured litigated claims while working in unison with internal legal counsel as needed.
  • Assist and provide guidance to internal team members with the resolution of moderately complex questions as it relates to the litigation process from start to resolution.
  • Determine cause of loss; retain appropriate experts based on claim facts and exposure.
  • Leverages strong critical thinking and decision-making skills to gather, assess, analyze, question, verify, interpret, and understand key or root issues.
  • Writes in a clear, succinct, and fact-based manner in Claims files as well as in other communication.
  • Manages time and diary entries effectively and efficiently.
  • Establishes and maintains effective relationships, gaining respect and trust of internal and external resources and customers.
  • State licensure must be obtained as needed


Qualifications

  • Preferred Juris Doctorate degree or paralegal certificate
  • Background in collections or litigation
  • Understanding of insurance, risk management and or claims handling preferred.
  • Travel as needed.
  • Ability to understand litigation process and management
  • Ability to professionally communicate and interact with internal and external parties.
  • State licensure preferred
  • Demonstrated skills in investigation, evaluation, and negotiation
  • Subject matter expert in litigation and legal processes
  • Understand contract law including risk transfer, additional insured tenders, ability to read and analyze contracts

Additional Responsibilities:
  • Mentor, onboard, and cross-train less seasoned team members
  • Facilitates and/or participates in special projects
