The Nebraska Department of Banking and Finance (NDBF) - Bureau of Securities is seeking an analytical and stellar communicator to fill an Investigations Supervisor role in the agency. Job duties

Under general direction, the Investigations Supervisor directs, coordinates, and supervises the investigations program for the Bureau of Securities. Directs Bureau resources and conducts complex investigations of administrative, civil, and criminal violations of the Securities Act of Nebraska, including securities fraud, and other consumer protection status. Supervises a Securities Analyst II. Conducts interviews and issues subpoenas for information and documents from officials, corporate officers, investors, and other interested parties for information related to investigations. Reviews and analyzes financial information, agreements, witness testimony, and other information. Applies statutes, rules, and regulations, to determine whether violations have occurred and whether to pursue enforcement action. Prepares and maintains evidence, serves as expert witness, and coordinates enforcement actions with Department Counsel. Supports local County Attorney Offices, State Attorney General's Office, or federal prosecutors in cases involving securities or consumer protection statutes. Establishes and maintains relationships with local police departments, the FBI, Attorney General's office, County Attorney offices, the U.S. Postal Inspection Service, other state securities regulators, other Nebraska State agencies, or other law enforcement entities for the purposes of coordinating administrative, civil, and criminal investigations, prosecution, or representing the Department of Banking and Finance as the expert in Nebraska's Securities law.

REQUIREMENTS: Bachelor's degree from an accredited college or university in a business-related field (accounting, business administration, business law, economics, finance, etc.) or an advanced degree in law or business administration. Three years investigative, regulatory, or compliance experience.

PREFERRED:

Securities enforcement background preferred.

OTHER:

Valid driver's license and evidence of vehicle insurance, or the ability to provide independent authorized transportation. Must be willing and able to travel overnight approximately 5% of the time. Ability to lift up to 25 pounds.

To comply with Neb. Rev. Stat. § 81-1396, the position will need to complete fingerprinting with the Nebraska State Patrol within 2 weeks of hiring or as soon as practicable. Costs of fingerprinting will be paid by NDBF.

Regular and reliable attendance is required.

Knowledge, Skills and Abilities

Knowledge of: the principles and practices of planning, monitoring, and evaluating investigations; the securities industry; the techniques and procedures used in investigations; the principles and practices of interviewing; the administrative adjudication and rule-making processes; law enforcement processes and procedures; business accounting and corporate finance; securities theory and practice; investigative techniques and principles; systems for processing complaints and tracking investigations; different techniques used to raise capital in Nebraska; and accounting and financial analysis; state and federal laws and administrative regulations pertaining to securities and consumer protection laws; investigative techniques used in the investigation of financial fraud; trial evidence laws concerning testimony on security fraud.

Ability to: deal effectively with personnel, issuers, legal counsel and the general public; supervise, review and evaluate the work of subordinates; pursue an investigation to a conclusion with determination and resourcefulness; maintain investigative material in confidence; communicate both orally and in writing; analyze and appraise all types of securities; plan, organize, delegate, and direct the work of agency employees; communicate and interact with others; read and understand rules, regulations, and guidelines and apply them to resolve problems; identify and extract pertinent information from records, conversations, and observations; make decisions and take action in dealing with problems and situations; prepare clear, concise written reports; detect and investigate securities and consumer protection fraud using knowledge of investigative techniques and financial examination; analyze a prospectus to determine its adequacy in disclosure to potential investors; clearly communicate the findings of an investigation to prosecutors and in court.
